Terms and Conditions of Sale

1. Company Information

These Terms and Conditions (“Terms”) govern all sales and services provided by Papa Tartufi, with registered office at Via A. Piccardi 1/A, VAT IT03033460548, Italy (“Seller”), contactable at [info@papatartufi.it](mailto:info@papatartufi.it).

2. Scope and Applicability

These Terms apply to all sales of products (“Products”) and related services offered on www.papatartufi.it (“Website”) to either consumers (end customers) or businesses (“Customers”) in all eligible shipping destinations, as specified at checkout. By completing an order, the Customer unconditionally accepts these Terms in force at the time of order confirmation.

3. Products and Availability

Papa Tartufi offers a wide selection of edible truffle-based products, preserves, condiments, mushrooms, fresh truffles (seasonal), gift boxes, and related gourmet goods. Specific offerings may vary by season or availability, as listed on the Website. All reasonable efforts are made to ensure product information is accurate. In the event a Product is unavailable after purchase, Seller will promptly notify the Customer and propose an alternative or full refund.

4. Recipients and Account Requirement

The Website is open to both private individuals and businesses (B2B), globally, subject to service availability by region and applicable law. Guest checkout is possible; registration is required only for access to certain services or reserved content.

5. Ordering Procedure

Orders may be placed through the Website with or without creating a Customer account. After Cart completion and address/payment entry, shipping fees and delivery options will be calculated and displayed at checkout prior to payment confirmation. Order confirmation is issued by email upon successful receipt of payment. Customers wishing to amend or cancel an order must promptly contact [info@papatartufi.it](mailto:info@papatartufi.it); changes cannot be guaranteed once processing or shipping has commenced.

6. Pricing, VAT & Payment Methods

All prices are listed in Euros (€), inclusive of Italian VAT where applicable. Shipping costs are calculated at checkout and shown prior to payment; additional costs (e.g., customs duties, import taxes for extra-EU shipments) are borne by the Customer, unless otherwise stated. Papa Tartufi accepts payment through major credit/debit cards, Stripe (including supported methods such as Apple Pay, Google Pay, PayPal, Klarna, and other Buy Now Pay Later (BNPL) providers if available). Cash on delivery is not available unless pre-arranged by direct contact. The Seller reserves the right to verify and reject suspicious transactions for security or legal reasons.

7. Shipping Policy

Papa Tartufi ships worldwide, subject to regional availability and regulations regarding perishable goods. Express delivery within Italy and most European countries is estimated at 24–48 hours; for remote areas and other countries, delivery may require 72 hours or more. Delivery timelines are indicative; delays may occur due to circumstances beyond Seller’s control. Final shipping fees are shown at checkout; availability of service for each destination is confirmed once the Customer enters the delivery address. Seller is not responsible for delays or non-delivery caused by force majeure, customs clearance, recipient unavailability, or incorrect address. Customs duties or import taxes for non-EU destinations are the exclusive responsibility of the Customer.

8. Right of Withdrawal and Returns

By EU law, Customers purchasing as consumers (not businesses) have a right to withdraw from the contract within 14 days from the day they (or a third party other than the carrier and indicated by the Customer) acquire physical possession of the goods. Exemptions: In accordance with Article 59 of the Italian Consumer Code and EU Directive 2011/83/EU, the right of withdrawal does _not_ apply to:

• Perishable or rapidly expiring goods (such as fresh truffles, mushrooms, and other short-life food products);

• Sealed goods which are not suitable for return for health or hygiene reasons and were unsealed after delivery.

For eligible non-perishable goods, the Customer must notify Papa Tartufi by email ([info@papatartufi.it](mailto:info@papatartufi.it)) of their decision to withdraw, providing order details. The Customer shall bear the direct cost of returning the goods unless goods are faulty, damaged, or not conforming to the order. Returns must be sent in the original packaging and condition.

Return Form

A return form or specific instructions will be provided by Papa Tartufi upon withdrawal request.

Refunds

After verification of returned goods, Papa Tartufi will process the refund within 14 days using the payment method originally used, unless otherwise agreed.

9. Product Conformity and Legal Warranty

All Papa Tartufi products are compliant with Italian and EU food safety standards. In the case of defective, spoiled, or misdescribed goods, Customers are entitled to replacement or refund in accordance with Articles 128–135 of the Italian Consumer Code and applicable EU provisions. Food products have no commercial warranty beyond legal conformity.

10. Limitations of Liability

To the extent permitted by applicable law, Seller’s liability for damages is limited to the value of the products sold. Under no circumstances shall Papa Tartufi be liable for indirect, consequential, or punitive damages, loss of profit or business, or damages arising from improper use or storage of products. For B2B Customers, the right to withdrawal is excluded unless specifically agreed in writing.

11. Intellectual Property

All content on the Website, including but not limited to text, images, names, recipes, trademarks, and logos, is the exclusive property of Papa Tartufi or its licensors and is protected under Italian and international copyright law. Any commercial use, reproduction, or distribution without prior written consent is strictly prohibited.

12. User Conduct and Account Policy

Customers may not resell, market, or distribute products purchased unless expressly authorized through a business agreement. Papa Tartufi reserves the right to suspend or delete any user account in the event of abusive, fraudulent, or non-compliant use of the Website. Minimum age for registration or purchase is as per the user’s country legislation.

13. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any dispute arising from or relating to these Terms or transactions with Papa Tartufi shall be submitted to the exclusive jurisdiction of the Court of the registered office of the Seller, unless mandatory consumer forum provisions apply.

14. Promotions, Vouchers, and Loyalty

Papa Tartufi may, from time to time, offer promotional codes, vouchers, or loyalty points; specific conditions will be detailed at the time of offer and may vary or be terminated at Papa Tartufi’s sole discretion.

15. Miscellaneous

If any provision of these Terms shall be found invalid or unenforceable under applicable law, such invalidity shall not render the entire Terms invalid; the affected provision will be replaced by a valid and enforceable one coming closest to the purpose and intent of the original.

Papa Tartufi reserves the right to amend these Terms at any time. The updated version shall always be available on the Website; material changes will be notified where legally required. Use of the Website and/or completion of orders after such amendments constitutes acceptance of the new Terms.
